Social Work And Assessment To Framework Social Work Essay Assessments have been a key element to the social work practice and we have seen many changes and developments within assessments over the years. The Childrens Act 1989 and other legislation such as Criminal Justice Act 1991 and NHS and Community Care Act 1990 all contributed towards the changes made within the assessment process. The objective has been refined based on two key factors. First being the public enquiries that indentified shortcomings in legislations, policy and practices within social work and secondly the governments agenda for modernisation. (Wilson, et al.2008). Historically the objective of assessments was primarily to consider the risks factors to children and families in accordance to legislation. However, since the framework for assessments was introduced in 2000, practitioners have been steered towards evaluating not only risks, but also needs and strengths of service users. Assessments are carried out to help both service users and Social Workers identify and understand the nature, rationale and degree of professional involvement. Although there are numerous definitions of assessments from social work academics, however, there is no one conclusive definition. Coulshed and Orme define assessments as; An on-going process, in which the client participates, the purpose of which is to understand how people relate to their environment; it is a basis for planning what needs to be done to maintain, improve or bring about change in the person, the environment, or both. (Coulshed and Orme, 1998, pp21). There is a debate amongst academics as to whether assessments are an art or a science; Bradley and Parker (2007) have explored the different assessment definitions and have concluded: A balance approach would suggest that social work assessment is both an art and a science since it involves wisdom, skills, appreciation of diversity and systematic applied knowledge in practice. (Parker and Bradley, 2007, p4) Although there are many definitions of assessments the objective remains the same, it is to identify needs and have a plan of interventions, which meets the objectives of all concerned. Assessments are a working document that can be legally binding, which need assessing, reviewing and planning. Assessments are a systematic process that include various components and involve methods such as, gathering of information, analysing objectively, collaborating with service users and other professionals including sharing of information with colleagues, assessing the eligibility and recording information accurately. (Thompson Thompson, 2008). There are many vital interpersonal and communication skills that are required when gathering information such as, good listening skills and have the ability to observe and absorb information correctly. Pamela Trevithick (2005) emphasise on the importance of verbal and none verbal communication, as well as listening and observation skills, before embarking on the assessment process. (Trevithick, 2005). Assessments are not just about gathering information, but are about having the ability and knowledge to make correct judgments and analyse objectively. Milner and O Byrne (2009) suggest that when analysing data, social workers will use knowledge and the theoretical perspectives which have been identified to expand their analysis. ( Milner and OByrne, 2009). In addition, upon analysing information consideration must be given to service users social, economical, cultural and ethnic background. Although assessment involve making informed judgement, it is vital to assess an individual need in relation to their environment. Milner and OByrne (2002) stress that it is crucial while making judgements social workers must avoid any form discrimination, such as labelling or judging peoples behaviour according to common stereotypes. Assessments are not a one way dialogue but rather a joint venture between service user and social worker. Although there can be the issue of power imbalance, it is crucial that there remains a shared power relationship whenever possible. Middleton (1997) has emphasised the importance of respecting individuality of service user during the assessment process, so that it can empower and help them manage and identify their individual strengths. In addition it is essential that social workers build a good relationship with service users, as they, must collaborate and share information with other agencies. There has been a heightened awareness that multi agencies collaboration is vital; however there are many barriers which have often contributed to the lack of communication between agencies. Sharkey (2000) has noted the underlying causes as being the different structure and values of the individual organisation. Social workers undertake assessments on behalf of the local authority therefore; eligibility depends upon a few factors, which include, need, the organisations criteria, resources and funding. Throughout the entire assessment process social workers must keep clear and accurate records of all the work undertaken and their findings. Social work assessments can be broken down into two types, one which is on-going and will change according to need and information, and the second being specific to the issues and will be limited to a particular time. However, these two components will often exist simultaneously in most assessments. Coulshed and Orme (2006) clarify that assessments are not a one off practice but are a process that continues even after a piece of work has been carried out. An on-going assessment process could be the result of subsequent changes that may occur in the service users life, and then responded to accordingly. By implementing this method of practice it ensures that the service users needs are adequately assessed and evaluated at all times. Pincus and Minahan (1973) have described assessment as a process that can be altered and adapted after obtaining new information and data, enabling the assessor to reassess the situation and review the effectiveness of their chosen cause of action. (Pinus and Minahan, 1973). Assessments that are carried out for a specific issues and are time limited, such as a court report or a case conference, are usually conducted in accordance to legal obligations. This formula is focussed on making judgements and identifying what is needed and how it can be achieved. This may not always be an accurate presentation of the service user life and may not hold any relevance in the future, but will target the issue within a particular the timescale. Furthermore, the level of assessment can be determined through the two types of assessments mentioned and by identifying the need and response levels of intervention, will give the service user a well structured and focussed base service. The importance of carrying out assessments is widely recognised in the area of social work practice and is a fundamental component in professional interventions. By carrying out assessments effectively and systematically, there are more chances of interventions to prove to be successful. At the heart of an excellent assessment there is careful planning, evaluating and applying appropriate professional involvement. Sutton (1999) has emphasised on the nature of assessment process with the ASPIRE model, Assessment, Planning, Intervention, Review and Evaluation. It is important that when discussing assessments, to be aware that this is not a singular action, but is also complemented by good interpersonal and communication skills. Due to the significance assessments have in social work practice, it is vital that the entire process is carried out with an objective and factual thought process. What Does American Education Need? For over four decades, the public education establishment has delivered one educational disaster after another. "Solution" after "solution" they have offered have fallen far short of promises. The education establishment's perennial answer to our education problems is increased education expenditures. Educational expenditures have skyrocketed (more than doubling every 20 years since 1960) and yet Scholastic Aptitude Test (SAT) scores plummet. National Assessment of Education Progress (NAEP) test results partially demonstrate our dismal education picture. Of 17-year olds taking the test: 47 percent could not express 9/100 as a percent; only 5 percent could calculate the cost per kilowatt on an electric bill that charged $9.09 for 606 kilowatts; 26 percent did not know the U.S. Congress was part of the legislative branch of government; 43 percent of high school juniors could not place World War I within the period 1900 to 1950; 75 percent could not place Abraham Lincoln's presidency in the era 1840-1880. (1) The education establishment's latest "solution", supported by President Clinton, is massive federal expenditures to hire 100,000 additional teachers. This they claim will reduce class sizes and thus improve academic performance. United States already has smaller classes than countries where student academic performance is much greater than ours. For example, Japan averages 41 students per class compared to 26 in the United States. In mathematics, where their students run circles around ours, their average math class size is 43 compared to our 20. (2) Breaking the education monopoly will solve most of the nation's education problems. A way to achieve this is through education vouchers or tuition tax credits. The basic feature of proposals for education vouchers is for state and local governments to make direct payments to parents, in the form of vouchers, that are used to pay tuition charged by public or non-public schools. The basic feature of tuition tax credits is to give parents a credit against their income taxes for tuition expenses. For example if a parent spent $3,000 in tuition to send their kid to a non-public school, all or a percentage of the tuition would be subtracted from the parent's tax liability. Tuition tax credits are far preferable to vouchers because we would not run the risk of government intervention in the form of state Departments of Vouchers. Opponents interested in maintaining the monopoly of education have advanced arguments against greater competition in the education of America's children. These arguments seem to be plausible; however, upon just a little bit of reflection they are simply baseless.

My First Day In The US Essay

As I remember it, the first day that I came to U.S. was June 26, 2006. My first day in U.S. was both exciting and upsetting, I was exciting about was seeing my mom for the first time over a year, the upsetting part is I had to leave my good memories in my hometown. I had to left all of that behind friends, family and schools. However, life moves on, things need to be done. When I got out of the terminal in LAX, I saw the smile on my mother’s face that was the happiest smile I hadn’t seen in a long time. She waved at me and she was wearing a white T-shirt and blue jeans. As we were walking towards the car in the parking lot, she asked me â€Å"how do you feel, are you happy to be here?† Then I answered â€Å"the weather is pretty good and the people seem nice.† As we headed to dinner from LAX, I noticed there are a lot of open roads in California that are well taken care of, and people tend to drive a lot faster here in California than in China. I said to my mom, â€Å"The roads here seems to be in better condition then in China.† My mom answered â€Å"Well, yes, the road construction in the United States has a higher quality than China, however, it takes more time to complete Highways here. Normally, in the United States it takes around 4-5 years to build a bridge. In China, as you know, it only take one year or two years tops, which that might be the reason why the roads here are a better quality than in China.† As we went along, I also noticed California drivers tend to be more aggressive than Chinese drivers, often changing lanes without using their turn signals. Californians also tend to drive a lot faster than those in China, might be because the roads are in better conditions. It only took us about an hour to the restaurant where we had dinner. It was called â€Å"The Hat†, in Victoria Gardens. I noticed along the road parking patterns in the United States are much more regulated. People in China park either way and either direction on the road, while people in United States park based on the direction of the road (i.e. if someone is driving on the right side of the road they just park on the right side of the curb). Inside the diner, we ordered a pastrami dip sandwich, and a tuna sandwich. They were both was tasty. The chili cheese fries were enormous. We didn’t even finish it all, but I loved â€Å"The Hat† from that moment on. However, as we waiting for the food, I saw on the menu, almost all the food is stylized around individual servings. Such as steak sandwich , french fries, pastrami dip sandwiches and soups. They are all served as separate courses (appetizers, main course, etc). Back in China, in my mind, I thought all of the food from every â€Å"individual† course is served together. As we were eating, I looked at the kitchen where they are making sandwiches, it seems that the kitchens of American style food are more peaceful. People tend to buy only things like lumps of fish that can’t be distinguished from other fish without a label or crabs that may have already been boiled. All you have to do is put them into the oven or the pan and cook them. In China, however, the kitchens seem very violent and active. All of the chicken, duck and fish are freshly cut in the kitchen. The kitchen is full of glimmering kitchen knives. I feel as if it is like a battle field. The atmosphere of American and Chinese food differ greatly. A lot of good American restaurants are generally built in beautiful scenic or metropolitan areas, so I sometimes feel as if American food is about â€Å"Eating the scenery† rather than â€Å"Enjoying the taste†. Time flies, I have been in the U.S. for more than six years. There are some more things that I didn’t notice on the first day I arrived in California. There are many cultural differences between the U.S. and China. In China, one of them is people think about ideas in a collective sense, often considering how their actions will affect their friends and families. Chinese people tend to collaborate before making a decision. Decisions are made for the greater good as opposed to personal choice. In America, prioritizing individual goals and motives over the group is considered the norm. The number one reason I came to U.S. was because my mother wanted me to. I had to leave all my friends and family behind. It was the hardest decision that I ever had to make because I didn’t want to disappoint my mother. Students in California are not as stressful as the students in China. There are be many actives available in California, because of more freedom to young people then would be in China. At last, to be in the U.S. is just like a new adventure, I learned many things that I could never learn in China. I met a lot of interesting people that I probably could never have met if I am still in China. Overall, looking back to the first day, I was like a country’s boy that just came into the city.

John Knowles novel, A Separate Peace Essay

In John Knowles novel, A Separate Peace, Knowles proves through an adolescent relationship, that in order to have a reliable friendship, one must accept another completely, revealing that jealousy can not co-excist within a friendship. Jealousy plays a major role in the deterioration of the relationship between Gene and Finny. Gene has a growing jealousy towards his bestfriend Phineas. Because Finny always â€Å"gets away with everything† and can be whoever he wants to be, while Gene feels as if he is imprisoned within his own body (Knowles 28). The dangerous envy Gene feels towards Finny is eating away at his soul and is in no way healthy for the friendship, or Genes well being. Because of this jealousy, Gene can not fully accept Finny and his mischevious ways and fears to become inured to the fact that Phineas will always be better then him, all without noticing the breathtaking talents he himself possesses. Knowles displays the friendship as a way to prove that jealousy can not only mentally but physically force one to do unthinkable and incomprehensible things to another. The jealousy Gene was hiding within his walls enventually broke and he â€Å"jounced the limb† making Phineas fall from the tree and break his leg (Knowles 60). Revealing that Genes competitive hatred towards Finny lead to unbelievable, malicious action to physically disable his friend. For though friendship is depended on one another, the balance between Gene and Phineas is unequal: Finny needed Gene to help him face adulthood, while Gene uses Finny as a constant comparison to his own hopeless life. Knowles documents when jealousy collides with friendship and the fear of it becoming a reality, when it effects a loved one . In the article â€Å"A Separate peace: Four Decades of Critical Response†by Lois Rauch Gibson, Gibson analyzed Knowles and his perspective on jealousy. By jouncing Finny off of the limb, â€Å"Gene can rid himself.. of the evil within† (Gibson 5). Although ridding himself minimal of jealousy, his unkindly act forced  Gene to be plunged into a new internal world war. With this new profound guilt he destroyed any feelings of affection he once has for Finny. With a consistent feeling of jealousy throughout their friendship and in preparation for the war, Gene wrote : â€Å"i was on active duty all my time at school: I killed my enemy there† (Knowles 196). Revealing that instead of being able to embrace the friendship Finny has always offered, jealousy took over Gene, and eventually all the insecurity kills Finny. To accept each other completely Gene knew this jealousy could not excist within the relationship, he also knew the peace was always Finny, and with him no longer by his side; Gene was able to find his own separate peace. Cmo emigrar legalmente a los Estados Unidos   Obtener una tarjeta de residencia permanente es el requisito imprescindible para emigrar legalmente a los Estados Unidos. Esa tarjeta tambià ©n se conoce como permiso de residencia o como green card.   Es cierto que se puede permanecer legalmente en Estados Unidos sin esa tarjeta, pero en otro estatus y siempre se tratarà ­a de una estancia temporal, aunque puede ser ms o menos larga. La tarjeta de residencia permite permanecer y trabajar de forma permanente en los Estados Unidos y puede ser, adems, un puente hacia la adquisicià ³n de la ciudadanà ­a americana por naturalizacià ³n. En este artà ­culo se explican las formas de obtener la tarjeta de residencia y trmites especiales, cules son los requisitos de que debe cumplir el solicitante, los tiempos de tramitacià ³n y, finalmente, cules son los errores que pueden causar el problema de que la green card no sea aprobada. Cà ³mo se adquiere la tarjeta de residencia permanente Aproximadamente, cada aà ±o fiscal 1 millà ³n de personas extranjeras obtienen la tarjeta de residencia por uno de los numerosos caminos creados por la ley para sacar la green card. La mayorà ­a, aproximadamente 6 de cada 10, la obtienen por ser familiar de un ciudadano o de un residente permanente.   Las estadà ­sticas acreditan que en la mayorà ­a de los casos se necesita un patrocinador, es decir, un familiar o una empresa, esto à ºltimo para el caso de trabajadores. Sà ³lo en casos especiales no se necesita patrocinador. Por ejemplo, ciertos casos de trabajadores excepcionales con reconocimiento internacional por su trabajo, asilo, loterà ­a de visas de diversidad o visas de inmigrante de inversià ³n EB-5, cancelacià ³n de la orden de deportacià ³n dictada por un juez, etc. Lo importante de este apartado es entender que no es suficiente querer emigrar. Es necesario reunir los requisitos para poder iniciar uno de los caminos creado por las leyes migratorias.   Trmites para la tarjeta de residencia Los trmites son diferentes segà ºn el tipo de camino que cada persona sigue para obtener la green card. Por ejemplo, en las peticiones de familia el patrocinador debe enviar la peticià ³n, probar parentesco, acreditar medios econà ³micos para el sostenimiento de la persona patrocinada, etc. Por el contrario, si se trata de una peticià ³n por empresa se va a necesitar una aprobacià ³n previa por parte del Departamento de Trabajo. En el caso de que se trate de asilo, se necesita una decisià ³n afirmativa parte del Servicio de Inmigracià ³n y Ciudadanà ­a (USCIS, por sus siglas en inglà ©s) o de una corte migratorio.   Si se trata de la visa de diversidad, hay que aplicar en octubre por internet en la pgina del Departamento de Estado y ganar una loterà ­a que se celebra en mayo del aà ±o siguiente, etc. Es decir, los trmites son distintos segà ºn el camino que se emplee para la residencia. Requisitos que debe reunir el potencial migrante En la fase final de la tramitacià ³n de la green card el proceso puede pararse y la peticià ³n negarse si se considera que la persona es inadmisible.   Es cierto que dependiendo del camino para la green card, algunas de esas causas no se tienen en cuenta, por ejemplo, estancia ilegal en casos de green card por razones humanitarias como la visa U. Pero la regla general es que hay que mirar con lupa esas circunstancias, ver cundo no aplican, cundo es posible pedir un perdà ³n, cundo hay que simplemente esperar o cundo no se puede hacer nada. En otras palabras, hay que asesorarse con un abogado de inmigracià ³n. Adems, en los casos en los que el problema surge por estancia ilegal en los Estados Unidos y se est en el paà ­s es conveniente entender cundo se puede ajustar el estatus a pesar de esa circunstancia y cundo no es posible y necesariamente hay que salir de USA para completar el proceso mediante un procedimiento consular. Esto es importante porque en el momento en que se sale de los Estados Unidos salta lo que se conoce como el castigo o penalidad de los 3 à ³Ã‚  10 aà ±os, que complica y mucho la obtencià ³n de la tarjeta. En otras palabras, si se tiene al menos una causa que convierte a la persona en inadmisible hay que asesorarse para ver cà ³mo aplica a las circunstancias personales de cada caso.   Duracià ³n de la tramitacià ³n Los tiempos de espera desde que se inicia el proceso de la peticià ³n al momento en que se aprueba y se obtiene la green card puede variar desde apenas 4 meses a ms de 20 aà ±os. En estos momentos los trmites ms rpidos son para los familiares inmediatos de ciudadanos, es decir, cà ³nyuges, padre, madre e hijos solteros menores de 21 aà ±os. Por otro lado, los mexicanos que son hijos casados de ciudadanos estn teniendo una demora superior a los 22 aà ±os. Las demoras, particularmente en peticiones de familia, hay que tenerlas en cuenta, porque pueden ser mucho ms largas de lo que se cree. Errores que perjudican el proceso de obtencià ³n de la green card Entre todos los errores destacan los siguientes: - Mentir a un oficial migratorio o del consulado. Y lo cierto es que es frecuente que la mentira sea sobre cosas que no afectarà ­an a la obtencià ³n de la green card. Sin embargo, el mentir es considerado un fraude de ley que es causa de denegacià ³n de la residencia. - Quedarse ilegalmente en Estados Unidos cerrando el paso a muchas de las formas de obtencià ³n de la residencia (aunque no todas ya que en algunos casos sigue siendo posible). - Casarse como turista inmediatamente despuà ©s de ingresar a los Estados Unidos - Casarse con un novio distinto al que patrocinà ³ la visa K-1 Conclusià ³n Hay muchas formas de obtener la green card. Pero como dice el dicho, hay las que hay y no se puede inventar lo que no hay. Adems, es importante entender los trmites, todo lo que se pide, dà ³nde surgen los problemas y cules son los tiempos de demora para la forma especà ­fica que se utiliza para sacar la green card.
